Indian Divorce Act 1969

Sub-section (1) of section 10 of the Indian Divorce Act, 1969.

Any marriage performed whether before or after the commencement of the Indian Divorce (Amendment) Act, 2001, may, on petiton peresented to the District Court either by the husband or by the wife, on the following grounds:

  1. Committed Adultery
  2. Ceased to be Christian
  3. Been incurably of unsound for 2 years
  4. Suffering from virulent and incurable form of leprosy
  5. Suffering from veneral dises in a communicable form
  6. Not hear for past seven years
  7. Wilfully refused to consummate the marriage
  8. Failed to comply with Restitution decree for 2 years or upwards
  9. Deserted petitioner for past 2 years
  10. treated petitioner with cruelty as to cause reasonable injurious for the petitioner to live with respondent
